Entering under an application, permit or notice
121 Entering under an application, permit or notice
(1) This section applies if an authorised person wants to enter a property—
(a) to inspect the property in order to process an application made under any
local government related law; or
(b) to inspect a record that is required to
be kept for a budget accommodation building under the Building Act , chapter 7
; or
(c) to find out whether the conditions on which a permit or notice was
issued have been complied with; or
(d) to inspect work that is the subject
of, or was carried out under, a permit or notice.
(2) A
"permit" is an approval, authorisation, consent, licence, permission,
registration or other authority issued under any local government related law.
(3) A
"notice" is a notice issued under any local government related law.
(4) The
authorised person may enter the property without the permission of the
occupier of the property— (a) at any reasonable time during the day; or
(b)
at night, if— (i) the occupier of the property asks the authorised person to
enter the property at that time; or
(ii) the conditions of the permit allow
the authorised person to enter the property at that time; or
(iii) the
property is a public place and is not closed to the public.
(5) However, the
authorised person— (a) must, as soon as the authorised person enters the
property, inform any occupier of the property— (i) of the reason for
entering the property; and
(ii) that the authorised person is authorised
under this Act to enter the property without the permission of the occupier;
and
(b) may enter a home that is on the property only if the occupier of the
relevant part of the property accompanies the authorised person.
