CLASSIFICATION OF PUBLICATIONS ACT 1991 - SECT 32
Evidentiary provisions
32 Evidentiary provisions
(1) In a proceeding for an offence against this Act, each of the following
documents is evidence of the matters stated in it— (a) a document purporting
to be a certificate given by the director or the convenor under the
Commonwealth Act , section 25 or 87 and stating either of the following
matters— (i) whether a stated publication has been classified;
(ii) if a
stated publication has been classified—the classification given to the
publication;
(b) a document purporting to be a certificate given by the
director and stating whether a publication is a submittable publication.
(2)
In a proceeding for an offence against this Act, it is not necessary to prove
the authority of the complainant to institute the proceeding.
(3) In this
section—
"convenor" means the convenor of the Classification Review Board established
under the Commonwealth Act .
