CHILD PROTECTION ACT 1999 - SECT 123A
Meaning of risk-assessed role
(1) A
"risk-assessed role" is a role for which the normal duties are likely to
require, permit or facilitate contact with a child, that is of a type, or
happens in a context, that may create an unacceptable level of risk for the
child.
(2) For subsection (1) , the normal duties of a person’s role are
likely to require or permit the type of contact mentioned in that subsection
if the duties include— (a) physically touching a child; or
(b) building a
rapport with a child as an integral and ordinary part of the performance of
the duties.
(3) For subsection (1) , the normal duties of a person’s role
are likely to facilitate the type of contact mentioned in that subsection if
the duties allow access to a child’s personal details, including, for
example, a child’s contact details.
(4) In this section—
"contact" includes— (a) physical contact; and
(b) face-to-face contact; and
(c) oral, written and electronic communication.
"rapport" means a relationship or understanding that is more than merely
polite and functional.
