Deciding compensation payable
153 Deciding compensation payable
(1) The chief executive must decide the reasonable compensation payable under
the claim within 60 days after the day the claim is received.
(2) In deciding
the claim, the chief executive may decide— (a) the reasonable compensation
payable; or
(b) to reject the claim; or
(c) to acquire the interest.
(3)
The chief executive must, within 10 days after deciding the claim, notify the
claimant of the decision and advise the claimant that the claimant may appeal
to the Planning and Environment Court against a decision under section 153 (2)
(a) or (b) .
(4) If the chief executive fails to decide the claim within 60
days of receiving the claim, the owner may appeal to the court as if the chief
executive had decided to reject the claim.
