What is reasonable compensation
154 What is reasonable compensation
(1) Reasonable compensation is (subject to subsections (2) , (3) and (4) ) an
amount equal to the difference between the market value of the interest
immediately after the change and what would have been the market value of the
interest if the change had not been made.
(2) Any benefit the owner obtains
from the change is to be taken into account in calculating the reasonable
compensation.
(3) If the owner owns land adjacent to the land for which the
payment of compensation is sought, the payment of compensation must also take
into account any benefit accruing to the adjacent land because of the change.
(4) If the land for which compensation is claimed has, since the change,
become or ceased to be separate from other land, the amount of compensation is
not to be increased because it has become or ceased to be separate from other
land.
