Orders to protect operative’s identity etc.
21J Orders to protect operative’s identity etc.
(1) The court with which a witness identity protection certificate is filed
may make any order it considers necessary or desirable— (a) to protect the
identity of the operative for whom the certificate is given; or
(b) to
prevent the disclosure of where the operative lives.
Examples of orders—
• an order prohibiting sketching of the operative
• an order that the
operative give evidence in the absence of the public
(2) A person commits
an offence if— (a) the person knows that, or is reckless as to whether, an
order has been made under subsection (1) ; and
(b) the person intentionally,
knowingly or recklessly contravenes the order.
Penalty— Maximum
penalty—2 years imprisonment.
(3) Subsection (2) does not limit the
court’s power to punish for contempt.
