EXPLOSIVES ACT 1999 - SECT 105
Obstruction of inspectors
(1) A person must not obstruct an inspector, or a person helping an inspector,
in the exercise of a power under this Act, unless the person has a reasonable
excuse. Penalty— Maximum penalty—500 penalty units.
(2) If a
person obstructs an inspector in the exercise of a power under this Act and
the inspector decides to exercise the power, the inspector must warn the
person.
(3) In warning the person, the inspector must tell the person— (a)
it is an offence to obstruct the inspector, unless the person has a reasonable
excuse; and
(b) the inspector considers the person’s conduct is an
obstruction.
(4) In this section—
"obstruct" includes assault, hinder, resist and attempt or threaten to
assault, hinder or resist.
