ENVIRONMENTAL PROTECTION ACT 1994 - SECT 362
When environmental enforcement order may be issued
(1) The administering authority may issue an order (an
"environmental enforcement order" ) to a person if the authority believes an
enforcement ground exists for the person.
(2) Also, the administering
authority may issue an environmental enforcement order to a person— (a) whom
the authority believes to be a prescribed person for a contamination incident;
or
(b) in the circumstances stated in division 4.
(3) To remove any doubt,
it is declared that the administering authority may issue an
environmental enforcement order to a person in relation to an activity even if
the person is the holder of an environmental authority that authorises, or
purportedly authorises, the activity.
