FOOD ACT 2006 - SECT 214
Obstructing authorised person
(1) A person must not obstruct an authorised person in the exercise of a
power, unless the person has a reasonable excuse. Penalty— Maximum
penalty—100 penalty units.
Note— If a corporation commits an offence against this provision, each
executive officer of the corporation may be taken, under section 260A , to
have also committed the offence.
(2) If a person has obstructed an
authorised person and the authorised person decides to proceed with the
exercise of the power, the authorised person must warn the person that— (a)
it is an offence to obstruct the authorised person unless the person has a
reasonable excuse; and
(b) the authorised person considers the person’s
conduct an obstruction.
(3) In this section—
"obstruct" includes hinder and attempt to obstruct or hinder.
