91D Hearing procedures
(1) The power to make rules of court under the
Supreme Court of Queensland Act 1991 includes power to make rules of court for
appeals to Magistrates Courts under this Act.
(2) The procedure for an appeal
to a Magistrates Court under this Act is to be— (a) in accordance with the
Uniform Civil Procedure Rules 1999 ; or
(b) in the absence of relevant rules,
as directed by a magistrate.
(3) In deciding the appeal, the
Magistrates Court— (a) is not bound by the rules of evidence; and
(b) must
observe natural justice; and
(c) may hear the appeal in court or chambers.
