(1) This section applies if—(a) a member, or a close relative of a member, has an interest that conflicts or may conflict with the proper performance of the member’s functions; or(b) the chief executive officer, or a close relative of the chief executive officer, has an interest that conflicts or may conflict with the proper performance of the chief executive officer’s functions.
(2) The member or chief executive officer must, as soon as practicable, disclose the interest to—(a) if the matter is being considered or about to be considered by the board—the board; or(b) otherwise—the Minister.Penalty—Maximum penalty—100 penalty units.
(3) If a member has disclosed an interest relating to a matter being considered or about to be considered by the board, the member must not participate in the board’s consideration of the matter.Penalty—Maximum penalty—100 penalty units.
