Requirement to give information or document for investigation
57 Requirement to give information or document for investigation
(1) In investigating a licensed provider, or a business or executive associate
of a licensed provider, the chief executive may, by written notice given to
the person, require the person to give the chief executive information or a
document the chief executive considers relevant to the investigation.
(2)
When making the requirement, the chief executive must warn the person it is an
offence to fail to comply with the requirement, unless the person has a
reasonable excuse.
(3) The person must comply with the requirement, unless
the person has a reasonable excuse. Penalty— Maximum penalty—200
penalty units or 2 years imprisonment.
(4) It is a reasonable excuse for
the person not to comply with the requirement if complying with the
requirement might tend to incriminate the person.
(5) The person does not
commit an offence against this section if the information or document sought
by the chief executive is not in fact relevant to the investigation.
