Replacement of key person licence
75 Replacement of key person licence
(1) A key person licensee may apply to the chief executive for the replacement
of the licensee’s licence if it has been lost, stolen, destroyed or damaged.
(2) The chief executive must consider an application and either grant or
refuse to grant the application.
(3) The chief executive must grant the
application if the chief executive is satisfied the licence has been lost,
stolen or destroyed, or damaged in a way to require its replacement.
(4) If
the chief executive decides to grant an application, the chief executive must,
on payment of the fee prescribed under a regulation, issue another key person
licence to the applicant to replace the lost, stolen, destroyed or damaged
licence.
(5) If the chief executive decides to refuse to grant an
application, the chief executive must promptly— (a) give the key person
licensee an information notice about the decision; and
(b) if the chief
executive believes there is currently a key relationship between the key
person licensee and a licensed provider—give the licensed provider a copy of
the information notice.
