Inquiries about person’s appropriateness to hold office
33 Inquiries about person’s appropriateness to hold office
(1) The chief executive may make inquiries about a person to assist in
deciding whether the person is an appropriate person to hold office under this
Act.
(2) If requested by the chief executive, the commissioner of the police
service must give the chief executive a written report about the person’s
criminal history.
(3) Subsection (2) applies to the criminal history— (a)
that is in the commissioner’s possession; or
(b) to which the commissioner
ordinarily has access through arrangements with the police service of the
Commonwealth, another State or Territory.
(4) The commissioner may also
notify the chief executive if an appointee is charged with, or convicted of,
an offence.
(5) A notification under subsection (4) may be made under
arrangements between the commissioner and the chief executive, including an
arrangement for the electronic transfer of information.
(6) In this
section—
"appointee" means a person holding office as an appointed justice of the peace
or appointed commissioner for declarations.
