LEGAL PROFESSION ACT 2007 - SECT 111
Nature of incorporated legal practice
(1) A corporation is an
"incorporated legal practice" if it engages in legal practice in this
jurisdiction, whether or not it provides services that are not legal services.
(2) However, a corporation is not an incorporated legal practice if the only
legal services that the corporation provides are either or both of the
following— (a) in-house legal services;
(b) services that are not legally
required to be provided by an Australian legal practitioner and that are
provided by an officer or employee of the corporation who is not an Australian
legal practitioner.
(3) Also, a corporation that provides legal services is
not an incorporated legal practice if the corporation is prescribed under a
regulation as a corporation that is not an incorporated legal practice.
(4)
Despite subsection (2) and (3) , a corporation that is not an
incorporated legal practice as mentioned in those subsections must comply with
any regulation applying provisions of this part, with or without changes, to
that corporation.
(5) Nothing in this part affects or applies to the
provision by an incorporated legal practice of legal services in 1 or more
other jurisdictions.
