LEGAL PROFESSION ACT 2007 - SECT 263
Investigations
263 Investigations
(1) The law society may, on its own initiative or if asked by the
commissioner, investigate the affairs of a law practice under this division.
(2) The investigation— (a) may be in relation to a particular allegation or
suspicion regarding trust money, trust property, a trust account or another
aspect of the affairs of the law practice; or
(b) may be carried out as a
routine investigation.
(3) The principal purposes of an investigation are—
(a) to find out whether the law practice has complied with or is complying
with this part; and
(b) to detect and prevent defaults in relation to the law
practice.
(4) Subsection (3) does not limit the scope of the investigation or
the powers of the investigator conducting the investigation.
(5) An
investigation of the affairs of a law practice under this division is a
"part 3.3 investigation" . Note— Chapter 6 applies to a part 3.3
investigation—see section 540 .
