Appointment of health assessor
88 Appointment of health assessor
(1) The relevant authority may appoint 1 or more appropriately qualified
persons (
"health assessors" ) to conduct all or part of a health assessment under this
division of a subject person.
(2) At least 1 health assessor must be a
registered medical practitioner.
(3) If the relevant authority considers the
subject person’s criminal history is relevant to the assessment, the
authority may disclose the history to the health assessor.
(4) The
Criminal Law (Rehabilitation of Offenders) Act 1986 does not apply to the
disclosure.
(5) Before appointing a person as a health assessor, the relevant
authority must be satisfied the person does not have a personal or
professional connection with the subject person that may prejudice the way in
which the person conducts the assessment.
(6) In this section—
"appropriately qualified" , in relation to a registered medical practitioner
or other person conducting a health assessment, includes having the
qualifications, experience, skills or knowledge appropriate to conduct the
assessment.
