MOTOR ACCIDENT INSURANCE ACT 1994 - SECT 43
Insured person not to admit liability
43 Insured person not to admit liability
(1) An insured person must not, without the insurer’s written agreement—
(a) make an admission of liability on a claim; or
(b) settle, or offer to
settle, a claim; or
(c) make a payment, or offer or promise to make a
payment, on a claim.
(2) A contract, offer or promise made in contravention
of this section does not bind the insurer.
(3) This section does not prevent
an insured person from providing a police officer with information reasonably
required to prepare a report on a motor vehicle accident.
(4) An insured
person incurs no civil liability to an insurer through contravention of this
section.
