NATURE CONSERVATION ACT 1992 - SECT 70O
Amendment of designation
70O Amendment of designation
(1) The chief executive may, by an entry in the proposed protected area
register, amend the designation of an area as a proposed protected area if
subsections (2) to (5) have been complied with.
(2) The chief executive must
publish a notice of a proposed amendment in a newspaper likely to be read by
people particularly affected by it.
(3) The notice must state the
following— (a) the location of the area;
(b) the proposed amendment;
(c)
that any entity may comment about the proposal to the chief executive;
(d)
the period during which comments may be made.
(4) The stated period must be
at least 35 days after the publication of the notice.
(5) The chief executive
must consider any comment about the proposal made during the period.
