138 Application of Judicial Review Act
(1) The Judicial Review Act 1991 , part 4 does not apply to a decision of the
Authority if the Supreme Court makes an order to that effect.
(2) The
Authority may apply to the court for an order mentioned in subsection (1) on
any of the following grounds— (a) the disclosure of reasons for the decision
may endanger the life or wellbeing of someone;
(b) the disclosure of reasons
may reveal the identity of an informant;
(c) the disclosure of reasons may
prejudice the investigation or prosecution of persons for an offence against
this Act;
(d) the disclosure of reasons may prejudice the proper
administration of this Act.
(3) The application must be heard in private and
without notice to the person seeking reasons for the decision.
(4) The court
may make an order only if satisfied that— (a) a ground mentioned in
subsection (2) exists; and
(b) the order is justified in all the
circumstances.
(5) The Authority must give the person seeking reasons for the
decision a copy of the court’s order.
