PROSTITUTION ACT 1999 - SECT 39

39 Application to be referred to commissioner
(1) The Authority must give to the commissioner any particulars it considers
relevant for each application for a certificate.
(2) On receiving particulars
of the application, the commissioner— (a) must make inquiries about the
applicant’s criminal history; and
(b) must make any other inquiries about
the application that the commissioner considers appropriate; and
(c) by
notice, may require the applicant to attend at a stated time and place to
provide all or any of the applicant’s identifying particulars.
(3) The
commissioner must report to the Authority after receiving the results of the
inquiries.
(4) The commissioner’s report may include recommendations.
(5)
The commissioner’s report must include reference to or disclosure of
convictions of the person mentioned in the
Criminal Law (Rehabilitation of Offenders) Act 1986 , section 6 .
