Consideration of application
40 Consideration of application
(1) The Authority must consider every application for a certificate by a
person who is eligible to apply.
(2) In considering an application, the
Authority may— (a) conduct the inquiries it considers appropriate; and
(b)
by notice, require the applicant to give further information the Authority
considers relevant to the application within a stated reasonable time, not
less than 14 days after the notice is given; and
(c) seek advice and
information on the application from any other entity it considers appropriate.
(3) An applicant is taken to have withdrawn the application if the applicant
fails to give the further information required by the Authority under
subsection (2) (b) within the time stated in the notice.
(4) The Authority is
not required to conduct a hearing to decide whether to grant a certificate or
refuse to grant a certificate.
