98 Abolition of consolidation of mortgages

(1) A mortgagor seeking to redeem any 1 mortgage is entitled to do so without paying any money due under any separate mortgage made by the mortgagor, or by any person through whom the mortgagor claims, solely on property other than that comprised in the mortgage which the mortgagor seeks to redeem.

(2) This section has effect despite any stipulation to the contrary.

(3) This section applies only where the mortgages are or 1 of them is made after the commencement of this Act.
