QUEENSLAND BUILDING AND CONSTRUCTION COMMISSION ACT 1991 - SECT 108C
False or misleading document
108C False or misleading document
(1) A person must not give an official a document containing information the
person knows is false or misleading in a material particular. Penalty—
Maximum penalty—100 penalty units.
(2) Subsection (1) does not apply to a
person if the person, when giving the document— (a) tells the official, to
the best of the person’s ability, how it is false or misleading; and
(b) if
the person has, or can reasonably obtain, the correct information, gives the
correct information.
(3) A person must not make an entry in a document
required or permitted to be made or kept under this Act knowing the entry to
be false or misleading in a material particular. Penalty— Maximum
penalty—100 penalty units.
(4) This section does not apply to a document
to which section 53B applies.
(5) In this section—
"official" means— (a) the commission; or
(b) an investigator performing a
function or exercising a power under this Act.
