Acting ordinary members
191A Acting ordinary members
(1) The Minister must establish a pool of persons to act as ordinary members
(the
"ordinary members pool" ).
(2) The Minister may approve a person as a member
of the ordinary members pool only if the person is eligible to be appointed to
the office of ordinary member under section 183 (4) .
(3) The Minister may—
(a) approve a person as a member of the ordinary members pool for a specified
time; and
(b) cancel the approval of a person as a member of the
ordinary members pool at any time.
(4) The Minister may approve a person as a
member of the ordinary members pool only after consultation with the
president.
(5) The Minister may appoint a person to act as an ordinary
member.
(6) The president may appoint a person from the ordinary members pool
to act as an ordinary member.
(7) An appointment may be made under subsection
(5) or (6) if— (a) there is a vacancy in the office of an ordinary member;
or
(b) an ordinary member is absent or for any other reason is unable to
perform the functions of the office; or
(c) the appointment is required for
the proper functioning of the tribunal.
(8) A person appointed to act as an
ordinary member— (a) has all the functions and powers of an ordinary member;
and
(b) is taken to be an ordinary member for all purposes relating to this
Act or an enabling Act.
(9) Without limiting subsection (8) , section 187
applies to a person acting as ordinary member as if the person were an
ordinary member.
(10) An appointment to act as an ordinary member may be for
a period of not more than 6 months.
(11) A person appointed to act as an
ordinary member may be appointed to act as an ordinary member for a further
period if— (a) the term of the appointment does not immediately follow the
person’s previous appointment as acting ordinary member; or
(b) the
appointment is continuous on 1 or more of the person’s previous appointments
as acting ordinary member and the total period of the continuous appointments
is not more than 6 months.
(12) The Minister or president may at any time
cancel the appointment of a person to act as an ordinary member.
