Application of amendments about transfer direction for a child who will turn 17 years
363 Application of amendments about transfer direction for a child who will
turn 17 years
(1) This section applies to a child who— (a) is subject to a detention order
made after the commencement; or
(b) at the commencement— (i) is serving a
period of detention; and
(ii) during the period of detention, will turn 17
years; and
(iii) on the transfer day, will have 6 months or more to be served
in detention.
(2) Subject to subsection (2A) , this Act applies to the child
even if 1 or both of the following happened before the commencement— (a) the
commission of the offence for which the child is subject to a detention order
or is serving a period of detention;
(b) the start of the proceeding for the
offence.
(2A) A requirement under section 276C (1) to give a prison transfer
direction within 28 days after the child is sentenced to serve a period of
detention is taken to be a requirement to give a prison transfer direction
before, or as soon as practicable after, the commencement of this subsection.
(3) In this section—
"transfer day" see section 276B .
