19 Building certifier’s obligation to keep record of decision about competency

If, under this part, a building certifier decides an individual is a competent person, the certifier must, for at least 7 years after the day the decision was made (the
"decision day" ), keep a record stating each of the following—

(a) the person;

(b) the matters for which the person was decided to be a competent person;

(c) the decision day;

(d) if, under section 17 (1) (a) , the individual was decided to be a competent person (design/specification) from a particular day (the
"competency day" ) that was before the decision day—the competency day;

(e) details of the documents or information relied on by the certifier to make the decision;

(f) the certifier’s reasons for the decision.

Penalty—

Maximum penalty—20 penalty units.
