EXPLOSIVES REGULATION 2017 - REG 190
Service provider must not give false or misleading information
190 Service provider must not give false or misleading information
(1) This section applies to a person (a
"service provider" ) who is employed or otherwise engaged by another person to
provide a service related to an explosive.
(2) The service provider must not
give information, or make a representation, to the other person that the
service provider knows is false or misleading in a material particular about
any of the following matters— (a) the type of authority held by the
service provider and the activities allowed under the authority;
(b) the type
of explosive the service provider is authorised to deal with under the
authority;
(c) a condition of the authority;
(d) the name or identity of the
person to whom the authority is issued;
(e) the name or identity of the
service provider.
Examples of making a false representation— 1 An
employee tells the employee’s employer that the employee holds an authority
to manufacture explosives when the employee does not hold the authority.
2 A
fireworks operator contracted by a fireworks contractor tells the fireworks
contractor that the fireworks operator is authorised to purchase fireworks.
Penalty— Maximum penalty—100 penalty units.
