71 Additional disclosure—settlement of litigious matters—Act, s 312
(1) For section 312 (2) of the Act , the matters in this section are relevant
to section 312 (1) of the Act when there is more than 1 law practice acting on
behalf of a client.
(2) A law practice that negotiates the settlement of a
litigious matter on behalf of the client (the
"negotiating practice" ) may ask any other law practice acting on behalf of
the client to give information needed for a disclosure under section 312 (1)
of the Act and state when the information is required (being a day and time
that is reasonable in the circumstances).
(3) A law practice asked to give
information under subsection (2) must comply with the request.
(4) However,
if the negotiating practice has retained another law practice to act on behalf
of the client, the only information required to be given by the other law
practice under subsection (3) is a reasonable estimate of the amount of legal
costs payable to the other law practice if the matter is settled.
(5) A law
practice given information by another law practice under this section is
entitled to rely on the information when complying with section 312 of the Act
.
