UNIFORM CIVIL PROCEDURE RULES 1999 - REG 118

118 Service on agent

(1) If a person living or carrying on business outside Queensland (the
"principal" ) enters into a contract in Queensland through an agent living or carrying on business in Queensland, the court may, without deciding the agent’s authority or business relationship with the principal, give leave for an originating process relating to a proceeding arising out of the contract to be served on the agent.

(2) The court must, in an order giving leave under subrule (1) , state the time within which the principal must file a notice of intention to defend.

(3) The party serving the originating process on the agent must immediately send to the principal a copy of each of the order and originating process.

(4) The documents required to be sent under subrule (3) must be sent to the principal’s address outside Queensland by prepaid post.
