Obtaining information about sex of person from registrar
113 Obtaining information about sex of person from registrar
(1) This section applies if— (a) an entry for an event in a relevant child
register states the sex of a person (the
"subject person" ); and
(b) the subject person or another person applies to
the registrar— (i) under section 110 for requested information, other than
historical information, about the event; or
(ii) under section 112 for a
certificate containing information, other than historical information, about
the event.
(2) The registrar may only give the requested information or
certificate containing a reference to the sex of the subject person if the
applicant requests that the registrar include that information.
(3) Also, the
registrar may only give the requested information or certificate containing a
notation of any previous sex stated in the relevant child register for the
subject person if— (a) the applicant requests that the registrar include
that information; and
(b) the applicant is— (i) the subject person; or
(ii) a child of the subject person; or
(iii) if the person is aged 16 or 17
years and gives consent to the release of the information or certificate—
(A) a parent of the person; or
(B) a person with parental responsibility for
the person; or
(iv) if the subject person is a child under 16 years— (A) a
parent of the child; or
(B) a person with parental responsibility for the
child; or
(v) a person prescribed by regulation.
