792B Meaning of place of safety(1) A
"place of safety" for a person who is intoxicated or who has ingested or inhaled a potentially harmful thing is—(a) if the person requires medical attention only available at a hospital—a hospital; or(b) otherwise—a place, other than a police station or watch-house, at which the person can recover safely from the effects of being intoxicated or the potentially harmful thing.Examples—• a place, other than a hospital, that provides care for persons who are intoxicated or who have ingested or inhaled the potentially harmful thing• a place where the person is living, whether on a temporary or permanent basis• a place where a relative or friend of the person is living, whether on a temporary or permanent basis(2) Despite subsection (1)(b), a place mentioned in that paragraph is not a place of safety if there is a risk of an act of domestic violence being committed by, or against, the person while at the place.(3) A vehicle, other than a police vehicle, is a
"place of safety" if the vehicle is used to safely transport the person to a place mentioned in subsection (1).
