103 Person must not conceal, destroy etc. particular documents
(1) This section applies in relation to the following (each a
"relevant document" )— (a) a document containing information requested by an
authorised officer under section 91 ;
(b) a document about an individual
whose affairs are the subject of an investigation of a reportable allegation
or reportable conviction under chapter 3 ;
(c) a document containing
information requested by the commission in performing a function under chapter
2 or 3 .
(2) A person must not— (a) conceal, destroy, mutilate or alter a
relevant document; or
(b) send, cause to be sent or conspire with someone
else to send out of the State a relevant document.
Penalty— Maximum
penalty—100 penalty units.
(3) It is a defence to a prosecution of an
offence against subsection (2) for the defendant to prove that the defendant
did not act with intent to defeat the purposes of chapter 2 or 3 or to delay
or obstruct the carrying out of an investigation under chapter 3 or 6 .
