38—Chief Executive may direct certain persons to undertake
rehabilitation program
(1) The Chief
Executive may, by notice in writing, direct a person to whom section 37
applies to undertake an approved drug and alcohol rehabilitation program of a
kind specified in the notice.
(2) A person must not,
without reasonable excuse, refuse or fail to comply with a direction under
subsection (1).
Maximum penalty: Imprisonment for 6 months.
(3) A notice under
subsection (1) must set out the information required by the regulations
for the purposes of this subsection.
(4) For the purposes
of this section, a reference to an "approved drug and alcohol rehabilitation
program will be taken to be a reference to a drug and alcohol rehabilitation
program of a kind approved by the Chief Executive by notice in the Gazette.
