140—Verdict for attempt where full offence charged
If on the trial of a person charged with any offence it appears to the jury on
the evidence that the defendant did not complete the offence charged but that
the person was guilty only of an attempt to commit the offence—
(a) the
jury may return as their verdict that the defendant is guilty of an attempt to
commit the offence charged; and
(b) in
that case—the defendant will be liable to be punished in the same manner
as if the defendant had been convicted on an information for such an attempt.
