14C—Person responsible for patient to make substituted decision
A decision of a person responsible for a patient to give, or to refuse to
give, consent under this Part must, as far as is reasonably practicable,
reflect the decision that the patient would have made in the circumstances had
his or her decision-making capacity not been impaired.
Note—
In cases where the patient has given an advance care directive under which no
substitute decision-maker is appointed, but the patient's wishes or
instructions in relation to treatment of the relevant kind is recorded, it may
nevertheless be necessary to give effect to those wishes or
instructions—see Part 5 of the Advance Care Directives
