75—Use of certain terms or descriptions prohibited
(1) A school that is
not registered on the schools register must not use a prescribed term, or
derivatives of the words comprising the term, to describe a service provided
by the school.
(2) If a school
contravenes subsection (1)—
(a) if
the school is an incorporated or trustee services provider—the school;
or
(b) in
any other case—the responsible authority for the school,
is guilty of an offence.
Maximum penalty: $50 000.
(3) A person who is
not registered on the schools register must not use a prescribed term, or
derivatives of the words comprising the term, to describe himself or herself
or a service that he or she provides.
Maximum penalty: $50 000.
(4) A person must not,
in the course of advertising or promoting a service that he or she provides,
use a prescribed term, or derivatives of the words comprising the term, to
describe a school that is engaged in the provision of the service unless the
school is registered on the schools register.
Maximum penalty: $50 000.
(5) In this
section—
"prescribed term" means—
(a)
registered school; or
(b) any
other word or expression prescribed by the regulations.
