South Australian Current Acts South Australian Current Acts164B—Approval or exemption does not operate in favour of person who
contravenes a condition
(1) If a person
contravenes or fails to comply with a condition or restriction specified in an
approval or exemption, the approval or exemption does not, while the
contravention or non-compliance continues, operate in that person's favour.
(2) If, by virtue of
subsection (1)—
(a) a
person is guilty of an offence against section 161A(1); or
(b) a
person is guilty of an offence against the provision of this Act from which
the person was exempted by an exemption,
the person may be proceeded against either for that offence or for the offence
of contravening, or failing to comply with, a condition or restriction of the
approval or exemption.
(3) In this
section—
"approval" means an approval granted by the Minister under
section 161A(1);
"exemption" means an exemption granted by the Minister under this Act.
