60—Appropriate board may direct person to surrender firearm etc
(1) The appropriate
board may, in relation to the release of a person on licence under
section 59 that is subject to the condition imposed by
section 59(7)(a), direct the person to immediately surrender at a police
station specified by the appropriate board any firearm, ammunition or part of
a firearm owned or possessed by the person.
(2) A person who
refuses or fails to comply with a direction under subsection (1) is
guilty of an offence.
Maximum penalty: $10 000 or imprisonment for 2 years.
(3) No criminal
liability attaches to a person to the extent that the person is complying with
a direction under this section.
(4) The Commissioner
of Police must deal with any surrendered firearm, ammunition or part of a
firearm in accordance with the scheme set out in the regulations.
(5) No compensation is
payable by the Crown or any other person in respect of the exercise of a
function or power under this section.
(6) The regulations
may provide for the payment, recovery or waiver of fees in respect of this
section.
(7) In this
section—
"appropriate board" has the same meaning as in section 59.
