545—Notice and effect of determinations
(1) If the regulator
makes a determination under this Part, the regulator must give the operator of
the determined major hazard facility a written notice of the determination,
stating—
(a) the
reasons for the determination; and
(b) the
date on which the determination takes effect, which must be at least
28 days after the date of the notice; and
(c) any
conditions imposed on the determination under regulation 544.
(2) The notice must be
given within 14 days of the making of the determination.
(3) The effect of a
determination under regulation 543 is that—
(a) the
operator is not taken to be a suitable person to operate the
determined major hazard facility; and
(b) the
exemption provided by regulation 535(3) does not apply to the
determined major hazard facility.

(4) A determination
takes effect on the date specified in the notice.
(5) A determination is
of unlimited duration unless it is revoked.
