549—Time in which major hazard facility licence must be applied for
(1) Subject to this
regulation, the operator of a determined major hazard facility must apply for
a major hazard facility licence within 24 months after the determination
of the facility.
(2) The regulator may
extend the time in which the operator of a determined major hazard facility
must apply for a licence if satisfied, on application by the operator, that
there has not been sufficient time to comply with Chapter 9 Part 3.
Note—
The exemption from the requirement to be licensed is conditional on an
application for a licence being made within the time specified by this
regulation (see regulation 535(3) and (5)).
Notes—
1 The operator of a determined major hazard
facility is required to comply with this Part for a specified period and to
prepare a safety case in order to apply for a major hazard facility licence.
2 The Act and Chapter 7 of these regulations
(Hazardous chemicals) continue to apply to a determined major hazard facility.
