36—Use of certain titles or descriptions prohibited
(1) A person who is
not registered on the appropriate register must not use a prescribed word, or
its derivatives, to describe himself or herself or a service that he or she
provides.
Maximum penalty: $50 000.
(2) A person must not,
in the course of advertising or promoting a service that he or she provides,
use a prescribed word, or its derivatives, to describe a person who is engaged
in the provision of the service but is not registered on the
appropriate register.
Maximum penalty: $50 000.
(3) In this
section—
"prescribed word" means—
(a) in
relation to registration on the chiropractic student register—registered
chiropractic student;
(b) in
relation to registration on the osteopathy student register—registered
osteopathy student;
(c) in
relation to registration on the register of chiropractors—
(i)
chiropractor; or
(ii)
manipulative therapist; or
(iii)
spinal therapist; or
(d) in
relation to registration on the register of osteopaths—
(i)
osteopath; or
(ii)
manipulative therapist; or
(iii)
spinal therapist; or
(e) any
other word or expression prescribed by the regulations.
(4) However, this
section does not prevent the title "manipulative
therapist" or " spinal therapist" being used by or in relation to a person
registered as a physiotherapist under the Physiotherapy Practice
Act 2005 .
