CHIROPRACTIC AND OSTEOPATHY PRACTICE ACT 2005 (NO 30 OF 2005) - SECT 57

57—Offence to give, offer or accept benefit for referral or recommendation

        (1)         A person must not give, or offer to give, a registered person, or a prescribed relative of a registered person, a benefit as an inducement, consideration or reward for the registered person

            (a)         referring a patient to, or recommending that a patient use, a health service provided by the other person; or

            (b)         prescribing, or recommending that a patient use, a health product manufactured, sold or supplied by the other person.

Maximum penalty: $75 000.

        (2)         A registered person, or a prescribed relative of a registered person, must not accept from any person a benefit offered or given as an inducement, consideration or reward for the registered person

            (a)         referring a patient to, or recommending that a patient use, a health service provided by that other person; or

            (b)         prescribing, or recommending that a patient use, a health product manufactured, sold or supplied by that other person.

Maximum penalty: $75 000.

        (3)         In this section—

"benefit" means money, property or anything else of value.
