59—Disposal of property on dissolution
(1) On the dissolution
of the trust under this Part, the property, rights and liabilities of the
trust vest in or attach to an irrigation trust or trusts specified for that
purpose by the Minister in the notice of dissolution.
(2) If in the opinion
of the Minister it is not practicable or appropriate to vest the property and
rights, or attach the liabilities, of the trust in or to an irrigation trust,
the property, rights and liabilities of the trust will vest in or attach to,
according to a determination of the Minister—
(a) the
Crown; or
(b) an
agency or instrumentality of the Crown (including a Minister).
(3) This section
operates subject to any provision made by a preceding section of this Part.
(4) In this
section—
"irrigation trust" means an irrigation trust constituted under the
Irrigation Act 2009 ;
"notice of dissolution" means—
(a) in
relation to a dissolution under section 57—the notice in the
Gazette under section 57(5);
(b) in
relation to a dissolution under section 58—the notice served on the
trust under section 58(4).
