This legislation has been repealed.
38—Administering authority may issue permits
(1) The
administering authority may issue to a person a permit authorising the sale of
a pre-packed article the sale of which would otherwise be an offence under
section 28 or 30.
(2) The issue of a
permit operates to authorise such a sale, in the circumstances and subject to
any conditions specified in the permit, by—
(a) the
permit holder, but only while the permit is in force; and
(b) any
other person, whether or not the permit is in force, if the permit holder
sells the article while the permit is in force,
so long as, at the time of sale, the seller gives to the purchaser a copy of
the permit concerned.
(3) The requirement
under subsection (2) that the seller give the purchaser a copy of the
permit does not apply if the sale to the purchaser is not for the purposes of
resale.
