43—Requirement for public weighbridge licence
(1) A person who makes
a weighbridge available as a public weighbridge is guilty of an offence unless
the person—
(a) is
the holder, or an employee of the holder, of a public weighbridge licence; and
(b) does
so in accordance with the conditions of the licence and the requirements of
this Act.
Maximum penalty: $20 000.
(2) It is a defence in
proceedings against an employee of a licensee in respect of a failure to
comply with a condition of a public weighbridge licence if the employee
establishes that the licensee failed to make the employee aware of the
condition.
(3) The regulations
may provide that the use of a weighbridge in a specified manner that would
otherwise be considered to be used as a public weighbridge is not to be
considered to be used as a public weighbridge for the purposes of this
section.
