If a person entitled to a judgment or order subject to the fulfilment of a condition fails to fulfil the condition –

(a) the person is to be taken to have abandoned the benefit of the judgment or order; and

(b) unless the Court or a judge otherwise orders, any other person interested may take any steps warranted by the judgment or order or that might have been taken if such a judgment or order had not been given or made.
