CHIROPRACTORS AND OSTEOPATHS REGISTRATION ACT 1997 (NO. 48 OF 1997) - SECT 38

Restoring name on register
(1)  Subject to this section, on payment of the prescribed restoration fee and annual registration fee the Board must restore a person's name to a register if –
(a) the person previously requested the removal of his or her name under section 36(1)(b)(ii) and requests that his or her name be restored to the register; or
(b) the person has had his or her name removed under section 36(1)(b)(iv) for non-payment of the prescribed annual registration fee and prescribed late fee.
(2)  The Board may waive the payment of all or part of the prescribed restoration fee.
(3)  The Board may refuse to restore a person's name to a register if it is not satisfied that –
(a) the person complies with the requirements specified in section 21(1)(b) , (c) , (d) and (e) ; or
(b) the person has adequate professional indemnification arrangements.
(4)  If the Board refuses to restore a person's name to a register it must, as soon as practicable, give the person notice of –
(a) the refusal and the reasons for the refusal; and
(b) the person's right of appeal.
