(1) The Rail Safety Regulator may direct a rail transport operator, by notice in writing, to amend the operator's safety management system within a period, specified in the notice, that is not less than 28 days after the giving of the direction.(2) A direction under subsection (1) must (a) state the reasons why the Rail Safety Regulator considers it is necessary for the rail transport operator to amend the safety management system; and(b) include information about the right of review under Part 10 .(3) The rail transport operator must not, without reasonable excuse, fail to comply with a direction under subsection (1) .Penalty: In the case of (a) a body corporate, a fine not exceeding 1 000 penalty units; or(b) an individual, a fine not exceeding 200 penalty units.
