ELECTRICITY SUPPLY INDUSTRY (TARIFF CUSTOMERS) REGULATIONS 2008 (S.R. 2008, NO. 79) - REG 21

Suspension of liability under disputed accounts
(1)  If an electricity retailer and a tariff customer dispute the amount of an electricity account but they agree to resolve the dispute by a process of arbitration, mediation or negotiation, the tariff customer has no liability under the account for the disputed amount during that dispute resolution process.
(2)  If a tariff customer makes a complaint under the Energy Ombudsman Act 1998 in respect of the amount of an electricity account before the due date for its payment, the customer has no liability under the account for the disputed amount until –
(a) the complaint is dismissed by the Ombudsman; or
(b) the Ombudsman completes the investigation of the complaint; or
(c) if the complaint is referred to a person under section 10(1)(b) of that Act, that person makes a determination.
